TERMS, CONDITIONS & PRIVACY
All the info you need for purchasing online & instore.
1. WEBSTORE PURCHASES
These terms and conditions apply to all purchases made through the Brazilia webstore at www.shopbrazilia.com. Please read them before placing an order.
1.1 About Us
Brazilia Designer Shoe Outlet is operated by Histerix (Pty) Ltd T/A The Brazilia Group, a retail company registered in the Republic of South Africa.
1.2 Acceptance of Terms
By using our website or placing an order through our webstore, you agree to these terms and conditions. If anything is unclear, please contact our customer care team for clarification.
These terms must be read together with our applicable website policies, including our Privacy Policy and Returns Policy.
1.3 Our Products and Brazilian Inspiration
While many of our shoes are made in Brazil, not all our products are sourced from there. Brazilia draws inspiration from Brazilian style, design and passion for life, and we import Brazilian footwear whenever possible.
1.4 Materials and Product Information
Not all our products are made from genuine leather. Where a product is made from leather, this will be indicated in its product description.
We take care in sourcing quality materials and footwear suited to the needs and preferences of South African customers. We make every reasonable effort to ensure that product descriptions and images accurately represent the items we sell.
1.5 Returns, Exchanges, Refunds and Factory Faults
We want you to be happy with your purchase. If you need to return an item, exchange a size or believe your product has a manufacturing defect, please contact our customer care team for assistance.
All returns and exchanges are subject to the conditions below and applicable South African consumer protection laws.
1.5.1 Returns and Exchanges Within 14 Days
Customers may request a return or exchange within 14 days of receiving their order, subject to the applicable return conditions and consumer protection laws.
For change-of-mind returns, including size exchanges, customers are responsible for the applicable courier costs for returning the item and receiving a replacement.
Items must be returned in a suitable condition for assessment. Normal wear and tear, misuse, abuse, negligence and accidental damage are not considered manufacturing defects.
Any applicable statutory cooling-off rights remain unaffected by this policy.
1.5.2 Factory Faults Within Six Months
If you believe your product has a manufacturing defect, you may submit a claim within six months of receiving the goods, in accordance with applicable consumer protection laws.
To help us assess your claim, please email customercare@braziliagroup.co.za with the following information:
- Your order number or proof of purchase.
- A description of the alleged defect.
- Clear photographs showing the issue and the overall condition of the product.
We may request additional photographs or ask for the item to be returned for physical inspection before reaching a decision.
Our team will assess whether the issue is consistent with a manufacturing defect rather than normal wear and tear, misuse, accidental damage, negligence or other damage occurring after delivery.
Where a manufacturing defect is confirmed, the applicable remedy will be provided in accordance with South African consumer protection law. Depending on the circumstances and the customer's legal rights, this may include a repair, replacement or refund.
Where a refund is applicable, it will be processed via electronic funds transfer (EFT), subject to any legally applicable requirements.
Brazilia will cover the applicable return courier costs for goods confirmed to be defective, in accordance with applicable law.
1.5.3 Assessment of Returned Goods
All goods submitted for assessment of an alleged manufacturing defect will be inspected by our team. Our assessment will be based on the condition of the product, the available evidence and the applicable consumer protection requirements.
If the assessment indicates that the issue is due to normal wear and tear, misuse, abuse, negligence or accidental damage rather than a manufacturing defect, the claim may be declined where justified by the evidence and permitted by law.
Where a claim is declined, the customer may be responsible for applicable collection and redelivery costs, where permitted by law.
Nothing in this section limits any rights a customer may have under applicable consumer protection legislation.
1.5.4 Hats, Perfumes, Bags and Wallets
For hygiene reasons, and to prevent items being used before being returned, hats and perfumes are generally excluded from change-of-mind returns and exchanges.
Bags and wallets are also excluded from change-of-mind returns and exchanges, as these items may be used for events or other occasions before a return is requested.
These exclusions do not remove any applicable consumer rights relating to manufacturing defects or other remedies required by law.
1.5.5 How to Request a Return or Exchange
To request a return or exchange, please email customercare@braziliagroup.co.za during our customer care hours:
Monday to Friday, 8:30 am to 4:00 pm.
Please include your order number and a description of your request. For alleged manufacturing defects, please also provide clear photographs of the issue.
Our team will guide you through the next steps, including any required inspection and courier arrangements.
1.6 Product Availability and Order Confirmation
Our products are subject to availability. Adding an item to your shopping basket does not reserve the item or constitute a completed purchase.
An order is subject to successful completion of checkout and confirmation through our ordering process. Order acceptance remains subject to applicable law.
If an item becomes unavailable after an order has been placed, we will contact you to discuss the available options.
1.7 Pricing and Website Information
We make every reasonable effort to ensure that product descriptions, images, prices, specifications and other information on our website are accurate and up to date.
Despite these efforts, errors or omissions may occasionally occur. If an error affects your order, we will contact you to explain the situation and arrange an appropriate resolution, including a refund where applicable.
We reserve the right to update product prices, descriptions, specifications and availability without prior notice. Such changes will not override any rights arising from orders already accepted or other applicable legal requirements.
Products displayed with pricing errors, such as a price of zero, may result in an order being cancelled, subject to applicable law.
1.8 Stock Availability
Our online stock information is updated approximately every 72 hours.
As our webstore stock is linked to availability across our retail store network, stock levels are not updated in real time. An item may therefore sell in-store before your online order is processed.
Although we take reasonable steps to minimise stock discrepancies, we cannot guarantee that every item displayed on our website will remain available at the time an order is processed.
If an ordered item is unavailable, we will contact you to discuss the next steps and arrange an appropriate resolution in accordance with applicable law.
1.9 Delivery Charges
Delivery charges may apply to orders. Any applicable delivery fees will be communicated during checkout or before the order is finalised.
For returns and exchanges, courier costs will be allocated in accordance with our Returns Policy and applicable consumer protection laws.
1.10 Order Processing and Dispatch
We aim to dispatch orders as soon as reasonably possible.
Dispatch times may vary depending on stock availability, the location of the item and any transfers required between stores or our distribution facilities.
Some items may need to be transferred from another store or region before they can be dispatched. This may result in additional processing time.
We will make reasonable efforts to communicate any significant delays and address orders that cannot be fulfilled within the applicable agreed or legally required timeframe.
1.11 Errors and Omissions
Errors and omissions excepted (E&OE).
We reserve the right to correct genuine errors or omissions in website content, product descriptions, pricing and other information, subject to applicable law and the rights of customers whose orders have already been accepted.
Nothing in these terms is intended to exclude, restrict or waive any consumer rights that cannot lawfully be excluded under South African law.
